Establishing Paternity of a Child Born out of Wedlock

If you are a single parent, then you may not be familiar with your child’s lineage. While mothers are often aware of potential partners, they may not be certain who the father of their baby is. This is especially true for women who are sexually active and have a variety of partners. This can cause a host of complications. For one, single mothers may need financial aid from the father of their child in order to provide for the baby. Another complication arises when a man arrives and claims that he is the father of the child. He may ask for visitation rights or want partial custody of the baby, but this may be impossible unless he can prove that he is a blood relation to the child.

According to a study at the University of Arizona an action may be brought in court to establish the paternity of a child that was born out of wedlock. Once a child’s parents are determined, they both have equal obligation to support and raise the child unless a person’s character or actions denies him or her that privilege. A mother, father, or guardian of a child has the right to establish that child’s parentage by allowing the adults and child to take part in a DNA test. This scientific and medical experiment can accurately determine who has a blood relation with the child.

Any party that is determined blood relation to the child in question can then be compelled to pay for the child. He or she also has the right to visit that child. In most situations, the parent who has had the child in their custody for the past six months will continue to host and house that child, while the other parent will only get visitation time. If you have more questions about establishing paternity then you need an attorney to come alongside you. Talk to a lawyer at Cutter & Lax today for more information!
